After doing some more research on the topic, I'd like to point something out.
Mojang aren't adding this to the EULA, it's always been there, this whole announcement thing is simply because they're re-wording it to make it more clear. They're not shooting themselves in the foot, if anything they did that when they first wrote the EULA.

Firstly, the way this is worded makes it have next to no effect, given that servers don't "Sell" perks, they give them as thanks for donating, they are giving no guarantee that they will give these perks if a certain amount is donated by one player, and no guarantee that these perks may be given to other, non-donating players at the staff's discretion.
The only ways they could actually prevent this, is either by making it illegal to give any perks to a player who has ever donated, making servers technically pay2lose, or making it illegal to give out perks to anybody without them earning a specific non-paid rank.
As for the whole "Donation run servers should just charge players to join" The majority of players on mine, and most creative servers are <14, it's highly unlikely these players are going to pay to join a server, especially if it's a monthly charge (Which it would probably have to be to secure the uptime of the server)
Also, something I haven't seen mentioned yet. How in the world are Mojang going to enforce this? I see it going something like this:
Player reports server
Mojang send C&D
Server ignores
Mojang can't contact host because home-hosted
Mojang block server IP from accessing login servers
Server goes offline-mode
Checkmate
Given the literal thousands of servers out there, it's completely impossible for mojang to actually enforce this rule on any violators without going completely bankrupt.
Plus, the server can always claim to be using custom-made server software that doesn't use mojang's code, and they can't verify this without looking at the server files, which in the case of home hosting they can't do without owner's consent, else privacy invasion.
Oh and for all of the people ing about "yay no more pay2win servers" there have always been servers that aren't pay2win, if you don't like pay2win, go play those.
I actually can't think of a single other game that allows "private" servers to be hosted by players and enforces this kind of idiocy. There are GMod servers that let you buy admin privileges, tf2 servers that let you buy OP Guns, CS servers that also let you buy admin privileges, even CoD and NS2 servers can be found giving perks to donators like this, simply because it is the single most effective model to fund a server. Anybody who disagrees show me an alternative.
Oh and if your alternative is "Get a job" do you actually know how much it costs to run servers like The Hive, Shotbow, Hypixel and Mineplex? I'm pretty sure the owners need some money left over for internet costs. -
