Guys, most gaming companies are going to allow for gaming videos to be uploaded and streamed in their ToS. So, it's mostly going to be okay. I, however, have no idea for indie games, so, yeah.
Does anyone know if MW3 will let people post videos? I personally think this bill is crazy. America is supposed to be about freedom,

I would like to point out that the bill doesn't define what a public performance is because that is not within the scope of this bill or even within the scope of Title 18. The term "Public Performance" is defined in Title 17. Its definition is as such:
To perform or display a work “publicly” means—
(1) to perform or display it at a place open to the public or at any place
where a substantial number of persons outside of a normal circle of a family
and its social acquaintances is gathered; or
(2) to transmit or otherwise communicate a performance or display of the
work to a place specified by clause (1) or to the public, by means of any device
or process, whether the members of the public capable of receiving the performance
or display receive it in the same place or in separate places and at the
same time or at different times.
"Performance" has no special definition, so we refer to its English definition
1. a musical, dramatic, or other entertainment presented before an audience.
2. the act of performing a ceremony, play, piece of music, etc.
That took me literally 5 minutes to find. Doing research isn't hard, folks.
I just remembered how I started playing minecraft. I heard some friends talking about it and then went home to look it up. I went on youtube and searched minecraft and found the shadow of israphel videos by the yogscast they made me go and buy a copy the next day. My point is that without the freedom to make videos like that then I would never have bought the game. The thing I always think when I hear about some company suing or taking down videos that have their product in them is that their getting free advertisment it's not like people say "Hey look at this cool game/song that I made." They give credit to the people that make it.

This describes the situation almost perfect. of this video, and of the bill getting re-written to exclude gaming vids from being "banned" from the internet. It also should allow you to post your own cover of a song, just not the original song if this passes. I think the bill will go through some heavy rethinking before they decide to actually pass it.
Except that is precisely what this bill intends to stop.
Which is what our government doesn't get, there is a difference between a 10yr old singing some lady gaga song and uploading it, and some random person uploading the original song. If this were to pass, it honestly wouldn't affect gaming videos that muchbecause most smart gaming companies would state in their ToS's that "footage of this piece of copyrighted material is permitted so long as the party(s) involved do not take credit for work they haven't done" It would go on and be a long, boring ToS, but give someone permission to make a lets play video as long as they don't claim the game is their own. I know what I've just said has been mentioned before in the vids in the OP and the comments. But if this were to pass the way it stands right now, our gaming community would go down. Way down. Wow, hey, have you read the law? There needs to be demonstrated a significant financial loss for the copyright holder or significant financial gain for the infringing party. If some 10-year-old sings Lady Gaga, nobody cares. If some 10yr old sings Lady Gaga and makes thousands of dollars off of it, then it's a crime. That 10-year-old didn't write the song and didn't ask to use it.

Technicly E3 woulndn't be closed down because the game designers are the ones showing their stuff off of this bill not being passed.

I also encourage you to form your own letter instead of using a pre-made petition letter. By doing that it shows that you care enough to use your time to write a letter personally. I personally talked about the natures and interests of the oranizations giving "donations" to the lawmakers supporting this bill. The two people who have gotten the most money have recieved over 2 million EACH. So go exercise your rights as an American citizen and let your opinion be heard!
