Mojang responds directly to questions about the EULA (both current, and future versions), tackling a number of hot topics relating to servers head on. Hopefully, this will answer a number of questions that have been flying around for the last few days!

Hello!
Let’s get one thing clear: we love it when Minecrafters host servers. Tiny or massive, running vanilla Minecraft or a heavily modded version, we think they’re all great. Playing with friends in persistent worlds is awesome. Everyone knows that.
Over the past week there’s been lots of discussion about Minecraft servers and your right to monetise them. Legally, you are not allowed to make money from our products. There has been one exception to this rule so far – Minecraft videos. We’re about to make a second exception – Minecraft servers.
Hosting servers can be expensive. We want to give community members a way to cover their costs. That said, we don’t want our players to be exploited, or to have a frustrating time unless they pay. The following rules, which may be tweaked at a later date, have been created with those points in mind.
You are allowed to charge players to access your server
So long as the fee is the same for all players, you are allowed to charge for access to your server. You are not allowed to split your playerbase into paying, and non-paying users, nor can you restrict gameplay elements to different tiers of player.
Basically, if you’re charging for access to your server, you are selling a “ticket” and there can only be one type of ticket, no matter how much people are willing to spend.
You are allowed to accept donations
You are allowed to accept donation from your players. You can thank them publicly, or in-game, but can’t give them preferential treatment for donating. You are not allowed to restrict gameplay features in an attempt to make money.
You are allowed to provide in-game advertising or sponsorship opportunities
Running servers can be expensive, with that in mind, you are allowed to put adverts in your Minecraft worlds to help with costs. Used within reason, adverts and sponsorship can be good ways to fund a server.
You are allowed to sell in-game items so long as they don’t affect gameplay
We don’t mind you selling items in game, but they must be purely cosmetic. Pets, hats, and particle effects are OK, but swords, invincibility potions, and man-eating pigs are not. We want all players to be presented with the same gameplay features, whether they decide to pay or not.
There is one exception to this rule – capes! We have a lot of fun making cool capes for extra-special members of our community and Minecon attendees. We’d like to keep them as exclusive as possible. So, yeah, no capes please, for free or otherwise.
You cannot charge real-world cash for in-game currency
We don’t mind you making up currencies which players earn through playing but you are not allowed to sell it for real-world cash. Remember – if the stuff you sell affects gameplay, we’re not cool with it.
Don’t pretend to be us, and provide your customers with loads of info!
If you do decide to monetise your server, you must clearly state that the purchase is not associated with Mojang, declare who the money is going to, and provide a purchase history and contact details. You should also check up on the legality of selling digital items in your specific region.
Thanks for reading!
As I hope you’ve noticed, these rules are making attempts to prevent Minecraft servers becoming “pay-to-win.” We hate the idea of server hosts restricting Minecraft’s features to players who have already bought our game! It seems really mean.
We’re hoping that these rules will give hosts opportunity to continue creating awesome Minecraft worlds, and for our players to enjoy them without worrying about cash.
This is an interesting subject, but, we all know minecraft games alike have done this many times. What will they do to enforce this rule? Shut down your server? Can they even find out who runs/owns it?
1. I have run a server under an alias with fake information before, and even on a private machine, which means they wouldn't be able to contact the host, because the host would be me, and the email would be unresponsive.
2. How I run a server, what ranks/tiers are payed for, or content I decide to run via plugins is non of their business...
Sounds to be like a fail by mojang to be honest. You cannot control how servers are being run...
I would love to see the reactions and discussions on this matter, this is sure to fail. I can't see anything bad happening if someone ignores these rules...
Wait, so we are no longer allowed to sell things like kits, and other stuff legally... so half the servers in mine craft are gone...
Let me give you some examples of people that are no longer following the EULA:
Mineplex
Hypixel
Skydoesminecraft's Server
And pretty much mostly every other server in the universe, including mine. This is very disappointing.

Actually, the entire time it was illegal, you, nor they never noticed.
This sounds good but I'm not sure if it can stop the monopolization of the player market our there by the big servers (I won't name them).
But this also means servers that aren't established or don't have the "getup" needed to be successful in the first couple of weeks or months of operation will have a tougher time growing if they don't have a creative idea in place. This is also good for those new owners though since they can adjust to the now enforced standards.

Think about it, what is mojang gonna do exactly? They can't spend their money to create cease and desists and lawsuits...its not possible. They would be losing money, didn't they post a thread 6 months ago about mojang "IF" not making enough money, minecraft would still be developing for about another 10 years before they have to close down?
I can see that this is absolute fail. I will charge my players for whatever I feel is unique and special about my server, they can't do anything about it. With all the mods/plugins out there, so what If I use special capes? Special items that we normally do not have? We payed for the game to run a server and play it.
GG Mojang, you won't win this round, starting to sound just like the rest of the companies.
I will laugh if it actually succeeds. Seriously, it isn't fair having items people can spend tons of money on to instantly win.
The only way this will succeed, is if mojang recodes minecraft with a master-server. This would mean that if your account gets flagged for abusing these rules, they will suspend your ability from hosting a minecraft server on your account. This also means in order to run a server on any machine you need to login to your account.
So basically it will be just like minecraft client.
1. Login, to host server.
2. Check if account is flagged for violations.
3. If not violation, host server.
4. Profit.
ELSE
3. Account flagged for violations.
4. Server disabled for online play, only LAN players can join.
5. YOU LOSE, GOOD DAY SIR.
That is the only way mojang can control servers, which i doubt their team will program. So 100,000 servers will continue to operate and abuse the EULA, which means absolutely crap. I don't see how this will be beneficial to anyone.

I'm not a server host, but the idea of preventing pay-to-win in Minecraft appeals to me greatly. People who make mobile apps and such like that are just... I can't describe my entire opinion on them with this forum's rules, but I'm sure you know what I'm thinking.
You're doing god's work, Gentlemen.

*ignores them*
I would argue that this entire thing is to give them a legal leverage to go after the big-boy offenders, rather than the small-to-medium offenders. Trying to offline 30,000+ servers who are 'breaking these rules, but not in a ridiculous manner' would be a DRASTIC waste of money and resources. But those giant servers who are charging thousands for benefits would be very, VERY prime targets to go after legally. Hiding their identity too, would be extremely difficult due to the contract with server hosts and the legal avenues that would force such info to be given to the law if it came to that extent.
Over-all I don't agree with these 'rules' in many facts.
#1 Allowed to charge access to your server, but NOT various ranks is a horrible idea. So instead of allowing free players, and 6 tiers of donators with VERY MILD and non-game breaking perks to co-exist - we have to force people to 'pay or not play'. It means instead of a fair balance allowing players to choose if they wish to donate or not, we have to push it to a system where you pay or don't play, since we can't use a more moderate, fair method.
#2 Generally speaking, as the poster I quoted said - really, trying to tell me what I can do or can't do on my server I pay for, on the custom plugins I've had created for my server is simply silly. Mojang doesn't own the functions/features of the addons. By rights, it should be my choice alone if a player group gets to use those plugins or nots, because I do not need to put them in the server unless I choose to do so. Players have no power over it. Don't get me wrong - not trying to come off aggressive here (text sucks for this) - merely stating it's just silly to try and control my server, which isn't paid or run by Mojang.
#3 No capes? Really? Again, silly rules. 'Please don't use this equipment slot, because we want to use it only, k, thanks!' - why not make it so minecon or similar 'special' capes ALWAYS over ride any server-side capes that exist, and make it 'illegal' to create copies of those capes into plugins for use? No stepping on toes, and restricts the intended function of the rule to the rule, instead of a blanket-ban which is silly and lazy.
#4 Charging for currency. this is bit of a pecker, as I see the validity of both sides. On one side, it's a nice feature of 'time vs effort' - pay to save your time to get ahead in the server (or more likely, to catch up somewhat to veteran players if a new player). Yet the other side, it can completely ruin a servers economy/balance if someone can literally buy everything they ever want by real life money, and really kicks the normal players in the ass, forcing them to 'donate' to even compete.
I myself use a dual system for my server. There is a normal in game currency that is used for most economy purposes, and a secondary 'donator' currency that is not spent on shops - but spent to buy 'perks' like a donator rank or similar. However, even non-donators CAN earn this special currency without paying a single dime. It's simply balanced around time vs effort (and I don't mean spending 300 hours to get a single benefit, it's balanced around a typical 1-2 hour a day player).
Why should a server who is fair with 'currency donations' be blocked? Why is it not the exploitive, unfair servers that are punished?
Over-all the entire rule system is a joke, and a giant, lazy blanket-ban without any indepth thought or true effort put into making it fair for LEGIT server owners, while punishing EXPLOITIVE owners who are taking the out of people.
And yes - I will ignore these rules. Not because I'm a 'rebel' - because I know what is fair for my server, for my players, because I care about my players as friends and players - not a paycheck, and ensure every single system I add that would breach these rules, is accepted and wanted by my player base.
And in the end, the problem is not per say the servers - it's the players. Don't pay these prices, don't play into these exploits, and these servers will be forced to change their tones or they will die. Players hold the power. Use it.

So basically this means no selling kits/ranks/classes any more? Because is this is so there will be pretty much no more mini game servers out there meaning that about(this is just a guess don't quote me) 50+% of minecraft players will no longer play minecraft. Please clear up any confusion im having about this if I got anything wrong.
And yes, in the end - I will ignore these rules. So you're going to intentionally engage in illegal activities and potentially get your server taken down just because you don't like the rules?

SPOT ON Sir.
I think these are the points that matter:
1. You payed for the minecraft client.
2. You did not pay for the server client, i believe its free to download and use by anyone?
3. How the server is run is non of mojangs business, as stated in 2., its free...
4. How the server is setup, payed/free, ranks, tiers, doesn't matter. Over 100,000 servers exist, is one player gonna be a ***** about it and stay on it? No, he has 99,000 servesr to choose from.
Servers can charge for anything, whenever, however they want. I do not see this working out for mojang...not one bit. I would love to hear some input from the mojang team, but I am pretty sure their lawyers have advised them to be hush-hush about it.
So you're going to intentionally engage in illegal activities and potentially get your server taken down just because you don't like the rules?
How is it illegal my friend? Bukkit at the moment is the only way to make freelancing java script coding and if you create a plugin that makes ranks for paid services, are you really gonna throw your +3 weeks of hardcoded work in the trash because mojang says NO? Nope.
Reporting me for what? Running my server the way I want to run it? Mojang has no control over anyone's server. End of story.
SPOT ON Sir.

My effort, my work, my rules.
#1 you paid more so to 'use' the game client and the content it provides.
#2 Server is free to use, but under a license by Mojang (they still 'own it' and all rights) - key here, I am not using the vanilla server at all, and use mcpc+ and am actually actively developing something entirely custom to my server that is rewriting all key systems of minecraft (can't say too much about this atm, but not to avoid rules ).
#3 It's not free, unless run off your computer. And then, your internet is not free nor is bandwidth, the hardware, etc, all paid for by you.
#4 That's the key point. If you disagree with 'pay to win' - DON'T PAY! But if you go to a server that is entirely fair, well run, creatively done, and you go HUR, I DUN HAVE TO PAY! SCREW YOU GUYS! - is that any better then those over charging? The reality is, servers need money to run. Donations are a necessary evil. If you disagree, tell me why? (not aimed at you specifically, just in general)
I do agree with them going after the exploitive jerk offs (excuse the language) who are ruining it with exploitive payment systems. But I do NOT agree with them attacking fairly run servers in the process.
I am not going to respond to the provokative, ravenous individuals who are trying to play the HUR, IT'S ILLEGAL, YOU GONNA BE ILLEGAL BRAH? responses. Be constructive in your opinions, not 'Mojang says, SO OBEY!'. Really nothing to discuss there.
1. I have run a server under an alias with fake information before, and even on a private machine, which means they wouldn't be able to contact the host, because the host would be me, and the email would be unresponsive.

Good riddance.
