A random question I would appreciate an answer to, say there was a server that had kits and what not that someone could make money off of, but the server has custom background music, if it was copyrighted is it likely legal action can or will be taken?
The laws on copyright differ from each jurisdiction but whether it was for profit or not is irrelevant, if it violates the law then technically the copyright holder could take you to court, the fairness of judgment or severity of punishment is then decided by them which could be anything from fines to prison sentence or both, although usually the largest punishments aren't usually done against small time offenders who aren't profiting off work or aren't hosting copyrighted music online for others to listen to without the owners permission. You may just get a cease and desist letter if you're fortunate, but there is still a possibility you could receive a big fine, so best not chance it.
