Hello everyone, i im making a new logo for my twitch channel and i am thinking of including a hand drawn diamond pickaxe in it. Am i allowed to do that or not since it will be shown in my streams and stuff.
In my experience companies are primarily interested in preserving their copyright for their brand name and company logos. A company must actively protect this intellectual property, otherwise courts may determine that the company has forfeited its rights to it.
Unless your logo closely mimics a Mojang, Microsoft or Minecraft or other official game logo, you shouldn‘t have to worry about a knock on your door in the middle of the night from the pickaxe police.
Keep in mind that serious companies do not maliciously “go after” fans who mistakenly use the companies’ intellectual property to promote the companies’ products. If they discover it they have to ask you to remove it even if they don’t want to. This happened several years ago when Microsoft conducted a sweep of the web to find websites using the copyrighted words “microsoft” and “windows” in their names. These were primarily community fan and support sites, and they were asked to have their names changed. Microsoft had to do this to demonstrate their efforts to protect their IP.
Whatever you do, don‘t write to Mojang to ask for permission and expect an answer. „Regular“ employees and external call centers who handle customer support issues for software companies aren‘t empowered to handle legal questions and will merely refer you to the End-user license agreement (EULA). Legal departments in such companies have bigger fish to fry and don’t have the capacity to answer end-user questions or follow up on frivolous infractions.
Having said that, if the EULA stipulates that you are not allowed to hand-draw a pickaxe and use it in your logo, then don’t do it if it makes you feel better.
