This thread is to spread awareness about how many servers are implementing a delay in sending messages in chat, and how it is against the EULA.
What is this chat restriction?
It is a (usually) three second rule on players that do not purchase a bypass from the server store. This bypass can take the forms of various things, such as "Ranks" and "Tickets".
Lately, many servers have begun to use this method as an attempt to gain finances.
While many servers regard it as a method to stop spam, it is actually illegal according to Mojang's "Monetization Post".
Here is a quote from Mojang's post:
"You are not allowed to restrict gameplay features in an attempt to make money."
In Vanilla Minecraft, there are no three second delays, and by imposing a rule only on non-paying players, this is considered a gameplay feature restriction.
Besides violating what was written in the Monetization Post (which is regarded as an extension of the EULA), it affects gameplay as well.
Many Minecraft games require the constant status updates to your team in chat, and some people enjoy having conversations with their friends online. To quote a friend:
"I bought Minecraft for over thirty dollars, and now I have to pay even more money to a third party site to talk with my friends"
Re-read the above statement. Now please read what Mojang wrote at the bottom of the Monetization Post:
"We hate the idea of server hosts restricting Minecraft’s features to players who have already bought our game! It seems really mean."
By imposing a rule so that non-paying players are enticed to purchase "Ranks" and "Tickets", server hosts are directly violating what was stated in the Mojang's posts.
Why am I posting this here?
I have tried numerous times to spread the word directly on the offending server forums, but many do not have forums, and those that do often ignore what was written.
This is an educational post to spread knowledge, and not instigate flame or offense.

Very, very well said. It seems stupid to have to pay money to lift a restriction on a vanilla component of the game. Above all else, it looks like a desperate attempt to make money off of a server. Accepting donations from elsewhere seems fine, but restricting chat simply because you choose to play the game without donating is just absurd.
Umm, I was talking about servers bro. And I am also very familiar with the Hypixel server. There is no chat delay whatsoever. And if there was one, so what? It's no big deal. And a chat delay wouldn't be illegal due to it restricting gameplay either. It could be considered as a cosmetic. I mean, people pay for their own separate chat channels on servers all the time, like VIP's on the Hypixel server. A simple delay is no different, it dosn't affect gameplay and plus it would gives moderators time to monitor the chat.
EDIT: If you are experiencing a delay, you can either chock it up to lag on your computer, or server lag. I mean think about it. The Hypixel server has about 12000 players on it at any given time. That would produce a LOT of server lag. I went to the grand opening party of the Hypixel server. There was over 16000 players in the main lobby, including Hypixel himself. And trust me when I say you would not BELIEVE the lag/delay. It took like 10 seconds for the fireworks to register on my screen after the countdown ended.

I'm afraid that you are misunderstanding my post as well as not fully reading it.
In case you refuse to open the file (understandable, due to the many computer viruses spread these days), attempting to say a second message in chat within three seconds prompts the message:
[b]"You can only chat once every three seconds! Buy VIP to bypass this restriction!"[/b]
(As a side note, this occurs to all players that do not pay money for the server. It is not a mute nor punishment given.)
It is very likely that you own a rank on the server, thus you are allowed to chat freely.

In reality, it is a big deal. Chat is not a cosmetic. It is communication. By being able to chat freely, a player can guide his or her team to victory. This affects gameplay.

This is what I am trying to say. Because chat affects gameplay (imagine the difference between a world without communication: no phones, no speaking, no email, no forums to post about illegal chat restrictions, and a world like ours where we can talk equally and without over half of us becoming mute after speaking a sentence), and is [b]a restriction on players that cannot or will not pay money[/b], it is not allowed.
The EULA is not an attempt to instigate large debates filled with people refusing to read. It is a document on attempting to give all players equal rights within servers, regardless if they want to donate or not.
As a closing note, I ask that you please read the original post before replying. This is a skill required in logical debates as well as a friendly and efficient community.

Let me start off by saying I really wish Mojang would just take away donations altogether. If you're not running a server for fun then you're just doing it for the money, and if you're just doing it for the money you will compromise the quality of the server in order to make a profit. I see too many servers selling God-swords, the ability to fly, or use world edit, stacks of hard-to-get blocks, in-game currency that can be used to buy land, and more. All of this is against the EULA, and I have filed very detailed reports on a couple of servers. No action was ever taken against these servers. As much as I wish Mojang cared about this kind of thing, they've already shown me that they don't. I highly doubt they will do anything about this, and it will probably become common practice on every server. They've already added command delays for teleporting on the server I play on. They also disabled breeding and used a plugin to make animal spawns super rare in order to cut back on lag. Whenever I'm around the admin's house or a donator's claimed land though I seem to see tons of animals. :/

I see what you mean now, but as you stated in the beginning, these restrictions are in place to control spam. Personally, I would rather have a 3 second delay between sending messages then having to suffer all of the spam/server advertisements on servers these days.

This is false, as stated in the Q&A Post written by Mojang:
"It doesn’t make a difference who made the mods, or how they were implemented onto your server. All mods require Minecraft to run. You are not allowed to charge for Minecraft features which affect gameplay."
Because these plugins are for Minecraft, and because Mojang owns Minecraft, it is against the EULA to charge for them. It is like saying:
"I decorated this apartment, and thus I can force you guys to pay rent."
The person that owns the apartment is the person that charges renters, not the decor manager.
A less known fact is that Mojang actually bought bukkit a long time ago. If you check Mojang's "Help Game", one question you can ask a Mojangsta is "That's a bukkit". The response is "Oh yeah, that. I bought that a long time ago."
Chat is still a Minecraft feature. If you download Minecraft, create a singleplayer world without mods, and press the T key, it will open chat. This was implemented in Minecraft's coding itself. Therefore, it is a Minecraft feature, and restricting it in an attempt to make money (i.e. buy ranks to bypass) is not allowed.

While some may agree, it still doesn't disregard the fact that it goes against the EULA.

In Minecraft, most people are on the servers to have fun, they will not listen to a person who says "Go left and we will kill this guy and steal the flag." They want to do what they want to do. Being able to chat freely does not change gameplay, unless you can not talk at all. I play on servers like this a lot and I have not seen 1 person try and take command. I have never seen anyone try and take command to try and lead his/her team to victory.
Lets say you are playing on a server and a guy is right behind your friend and he doesn't even know. He is 1 second away from dying, You hit T and then type really fast. But by the time he is dead, and you didn't even need to send that message. Minecraft is fast paced, and by the time you start to type that message, your friend will already be dead.
But if a server were to say "You have to donate for VIP to chat", meaning you can not chat unless you have VIP, or "You can only talk to people 50 blocks away unless you donate for VIP", this may change a little bit of gameplay features. But just waiting for 3 seconds to talk again will not change any aspect of gameplay features. In fact, you do not need to be talking every single second. I only talk every 3 minutes.
Indeed it is a minecraft feature, but it will not effect gameplay. (Assuming you have to wait a couple seconds to talk again).
But then you will bring up this, that it is frustrating to wait to talk.

But, I get frustrated when I want to use /hat but I can not, because only donors can. The EULA says that minecraft server owners can sell cosmetics, but normal players who do not donate may get frustrated when they see a guy with particle effects around their head.
In my opinion, waiting a few seconds to talk will not change any part of gameplay. But, who needs to talk every second? No one needs to talk every second. Even if you still are not convinced, why not just open up skype and talk to your friend, or use a different chat method while playing on those servers.
Your reply is quite long, but the general message is this:
"You don't have to talk, and therefore it doesn't affect gameplay".
However, all of your examples are situational, as well as not following a few other quotes I added.

While that may be true for some people, it is not true for all people.
These are situational arguments, and do not apply to every situation.
Players could be playing Towny, with no deaths.
When I play Minecraft, I respect others and listen to their reasoning, rather than ignore them or skim over parts that I refuse to hear. Therefore, chat does affect gameplay.

Chat is a Minecraft feature. Game-affecting or not, it is still a Minecraft feature. Please download Minecraft and attempt to chat. You will notice that without mods or servers, the ability to chat is within Minecraft's coding. It is therefore a Minecraft feature, and as the quote says
attempting to restrict a minecraft feature in an attempt to make money is NOT allowed.
Reading your post, it occurred to me that you believe the definition of restrict to be:
"not able to, disabled"
However, the definition of restrict is:
"limited"
Therefore, imposing a rule that slows chat and entices players to spend money (through Ranks, Tickets, etc) is NOT allowed.

Does reporting a server mean anything will happen? No, not necessarily, but if the server is not reported, or an attempt is never made to get the said server in compliance, nothing will ever change.
As much as I wish Mojang cared about this kind of thing, they've already shown me that they don't. I highly doubt they will do anything about this, and it will probably become common practice on every server.
I just want to put my 2 cents in, first off, I myself own and host my own server. I do not speak for everyone with internet but I have my server hosted at home and it sits to my left on my floor under my main PC. I do not require donations or some company to host my server for me as it is at my house directly, also if something fails within said server PC I can easily repair/replace what screwed up.
I plan on never needing/having anything on my server be pay-to-play or restricted for paying players, to me it's just rude and unjust. now before other server owners flame me for seeming like i'm being one sided, I understand some people have quite large servers that are not possible to be hosted at there house and must be hosted by an outside source and yes, those situations can get pricy, so I understand sometimes it's not that easy to keep a popular server running but as referenced before, restricting even something simple like chat for money is not right.
that's my opinion on things like this and hopefully what I have said has not been offensive to anyone.
What a pathetic attempt to bleed further financial resources from there customer base it just goes to show you how much they don't respect there players that they would restrict basic concepts and already established ones within the original format of the game for the sake of profit is completely in disregard to the respect one server should provide for it's costumers and it's players in general and constitutes an action against these servers by mojang and there subsidiaries.

Being able to chat freely does not change gameplay, unless you can not talk at all. I play on servers like this a lot and I have not seen 1 person try and take command. I have never seen anyone try and take command to try and lead his/her team to victory.
Lets say you are playing on a server and a guy is right behind your friend and he doesn't even know. He is 1 second away from dying, You hit T and then type really fast. But by the time he is dead, and you didn't even need to send that message. Minecraft is fast paced, and by the time you start to type that message, your friend will already be dead.
But if a server were to say "You have to donate for VIP to chat", meaning you can not chat unless you have VIP, or "You can only talk to people 50 blocks away unless you donate for VIP", this may change a little bit of gameplay features. But just waiting for 3 seconds to talk again will not change any aspect of gameplay features. In fact, you do not need to be talking every single second. I only talk every 3 minutes.
Indeed it is a minecraft feature, but it will not effect gameplay. (Assuming you have to wait a couple seconds to talk again).
But then you will bring up this, that it is frustrating to wait to talk.

But, I get frustrated when I want to use /hat but I can not, because only donors can. The EULA says that minecraft server owners can sell cosmetics, but normal players who do not donate may get frustrated when they see a guy with particle effects around their head.
In my opinion, waiting a few seconds to talk will not change any part of gameplay. But, who needs to talk every second? No one needs to talk every second. Even if you still are not convinced, why not just open up skype and talk to your friend, or use a different chat method while playing on those servers.

Your reply is quite long, but the general message is this:
"You don't have to talk, and therefore it doesn't affect gameplay".
However, all of your examples are situational, as well as not following a few other quotes I added.

While that may be true for some people, it is not true for all people.
These are situational arguments, and do not apply to every situation.
Players could be playing Towny, with no deaths.
When I play Minecraft, I respect others and listen to their reasoning, rather than ignore them or skim over parts that I refuse to hear. Therefore, chat does affect gameplay.
Another important thing you seem to be missing is:
"You are not allowed to restrict Minecraft features in an attempt to make money."
Chat is a Minecraft feature. Game-affecting or not, it is still a Minecraft feature. Please download Minecraft and attempt to chat. You will notice that without mods or servers, the ability to chat is within Minecraft's coding. It is therefore a Minecraft feature, and as the quote says
attempting to restrict a minecraft feature in an attempt to make money is NOT allowed.
Reading your post, it occurred to me that you believe the definition of restrict to be:
"not able to, disabled"
However, the definition of restrict is:
"limited"
Therefore, imposing a rule that slows chat and entices players to spend money (through Ranks, Tickets, etc) is NOT allowed.

Alternatively, you could report servers who are clearly in violation of the EULA no matter how big or small the offense is.

Does reporting a server mean anything will happen? No, not necessarily, but if the server is not reported, or an attempt is never made to get the said server in compliance, nothing will ever change.
I just want to put my 2 cents in, first off, I myself own and host my own server. I do not speak for everyone with internet but I have my server hosted at home and it sits to my left on my floor under my main PC. I do not require donations or some company to host my server for me as it is at my house directly, also if something fails within said server PC I can easily repair/replace what screwed up.
I plan on never needing/having anything on my server be pay-to-play or restricted for paying players, to me it's just rude and unjust. now before other server owners flame me for seeming like i'm being one sided, I understand some people have quite large servers that are not possible to be hosted at there house and must be hosted by an outside source and yes, those situations can get pricy, so I understand sometimes it's not that easy to keep a popular server running but as referenced before, restricting even something simple like chat for money is not right.
that's my opinion on things like this and hopefully what I have said has not been offensive to anyone.

What a pathetic attempt to bleed further financial resources from there customer base it just goes to show you how much they don't respect there players that they would restrict basic concepts and already established ones within the original format of the game for the sake of profit is completely in disregard to the respect one server should provide for it's costumers and it's players in general and constitutes an action against these servers by mojang and there subsidiaries.
I'm glad this is here and I hope more people will pay attention to it.
What does bukkit have to do with this? Also, even though the eula may make this illegal, I don't think mojang would do anything. I have yet to hear of one time where they have done something.
