I kind of appreciate that Mojang is making it so that servers can't restrict features. I hate going on a server just to see someone who can do more just becuase they donated money to a server. Not that I couldn't donate, but I'm not sure I'd make a 20$ commitment to a Minecraft Server that could shut down tomorrow.
I understand what Mojang is trying to do here... They are trying to make it so no one player can be the so called "god" of the server by paying a couple hundred dollars for some items. I would be fine with all of these new rules, IF they had cracked down on them in the first place. Enforcing the new rules right away would have prevented any of these issues from arising now.
So how many server have been shut down thus for for making special features payable? I take it none, cause mine is still up and...I have these so called "god" players? What they gonna do...ban me? Hall of Shame?

Mojang has no control over what I do IN my server, if I call someone a "****" or whatever its my server, what I do in my minecraft world I can blow up your house to screw you over as much as I want. So I surely can prevent you from using certain features too. I think mojang is getting too greedy like microsoft.
I bet no one realized the true intentions behind all this, Mojang started earlier a "Minecraft Realms" system, basically servers provided by Mojang themselves for you to use instead of using your home connection or NFO servers. That being said, they get the money instead of those hosts. By preventing the server owners from charging people for special features ( I bet you this includes bukkit features), you cannot give a donor access to the GIVE command that pays for it, while a normal player does not.
Just a lame attempt to make more money, what is even more funny, this same issue arose when they made a news article about what would happen if Minecraft didn't make enough money to stay alive, they said 10 years from that point minecraft would still develop, but after that it would die. This all links to this EULA thing.
I have not touched MineCraft since 1.6 was released, main reason is im waiting for 1.8 to get officially released. I host a server and my friend runs the donations, I didn't get a cease and desist, this is just a scare tactic, and until it really becomes out of control. I doubt Mojang will do a thing.

90% of servers these days are horrible and boring, because the donators get amazing kits or crazy overpowered perks that should NOT be available just for forking over your money.
The only people that are (and righfully so) freaking out are 1 of 2 things (maybe both I guess)
1. A player of a server that isn't good enough for the players to wish to ACTUALLY DONATE to it
2. The owner of the server stated above ^

you do realize, that mojang technically owns "your" server? they are the entire reason why you can even play the game, the least you could do is respect their wishes.

You would put prot 10 in your shop and make it cost 1 mil, but if you were a donater you could get it for free. The item would still be able to be bought by people who dont donate but it would be free for people who donate. This dose not break the EULA.

This person did not donate for an ingame item but for a soft money on their website. This soft money on the website can then be turned in for special items. The problem is what exactly are they gonna do? If they don't want to hire a team of people that do nothing but send out c&d notices all day then I see black for enforcing these rules.

This has more problems than benefits. I don't want to pay money to join my favourite server. Also this ne EULA means that no matter how much money you pay, you are still an equal with every else so ranks are useless now. . . This is going to hurt smaller servers a lot and what will happen to people who just want to host a small server for their friends? This is dumb.

How about another worst-case scenario : You're an old player in the server , but didn't buy any ranks . and you are very experienced . a newbie comes recently and buys a rank , TADDA ! Instant enchanted diamond armor ! He killed you and you're very angry .

They could just block the server from going through authentication or they could just terminate the owners account as they are violating the EULA.

They are not selling any Mojang Assets, they are accepting donations so you can get a boost in your game experience. The same thing that MMO's do like Maplestory. You buy stuff to have an advantage over the free players. That is it. No also be reminded, modded servers are not mojang assests because the images, objects, bars, ores, blocks created in the mod are actually created by another author under the free license to mod the game, which the owner of a server can then also use to be limited to donor access...

Exactly, this is all Bark and no Bite. I knew a few servers who are VERY POPULAR, minecraft has endless possibilties. From prison servers to simple survival, and you can make ANYTHING YOU WANT, Donor Accessable only. If I want to make a donation of 19.99 for a Fortune X, Efficiency X Diamond Pickaxe, then So be it. It is not mojang's asset I am selling. I am not selling anything, therefore I am not violating anything. The key word here is "Donations" to keep the server ALIVE, you know it costs money to play on the internet and run a pc, so much as running your own server on your own network.

You do realize that Mojang does not OWN my "PC" as it located between 0-1000 miles away from their grasp, which in turn, means that they do not OWN my server either. My hardware, my internet, my power, and my setup. I am using their software under FAIR USE, and I paid a "License" to use it. Also, the SERVER is free, unlike the Client which you pay for. SO I can host a server and NOT OWN minecraft at all to manage a server. Hell I don't even need to buy minecraft to play and run my server
FACT IS, Donations to run a server has been around since multiplayer servers existed, this includes Call of Duty, Terraria, Left 4 Dead, Minecraft, god forbid, even illegal copies of mmo's like Maplestory (besides the point), but those games that provide you with a Dedicated Server client ALLOW you to host a server under your own terms and rules. The only thing I can't do:
- Sell my server (as the entire entity) to another person/company.
- Cannot sell my copy of the game to another person/company.
- Cannot use content in the game to sell person/company or use the content in another software for copyright reasons.
- Donations are optional, which means NO ONE is forced to do it. You do this on your own terms. By not donating, no one really wins.
I am running 3 different servers, Terraria, Minecraft, and Left 4 Dead, i have not gotten a C&D or any kind of punishment yet. and I won't be getting any until the day I die or stop running those servers. So I really don't see why everyone things this EULA thing is gonna take into affect. Cause its not. Hell, I am not even banned from the forums yet, if this was such a big deal then my posts must be one heck of an offending thing to mojang.
I am not going to say if I am for or against the EULA, there is enough raging at each other over it as is.(Trust me I am sure you will figure out what side I am on once you read all I wrote) I am going to ask something that's been on my mind. People are very upset their server is going to die and say the donations are needed....Then why not just donate? Why must you have something in turn? If you think they are the only ones, go look at mod pages and see the copyright on some of those who clearly explain how you can use their mods, such as in modpacks, servers and right down to if you can make money using it on your server or not.

An IDEA for banning bad players/noobs/griefers(I don't know if it's gonna work):
1. If someone messes up real bad, like a griefer or a n00b, ban them.
2. Charge them about 100-150 dollars if they want to join your server again.
3. If it doesn't work that way, don't blame me, I'm just trying.
