My source that they are not technically a server is you. Your first reply to this thread is the source. You said "As I understand it, as far as consoles go, there are no "servers"."
As for the source you gave me, it doesn't specifically say that the EULA is for all platforms (unless I missed something), but it does say that it affects all servers and players equally. Is that the specific part of the post you were talking about.
"Servers" was in quotes, meaning that the console versions don't have traditional 'servers' like most people think of them (third-party, outside, separate). That does not mean that a console can't be a server in and of itself.
May also want to consider your on an Xbox which means your subject to Xbox live terms and agreement... and their conduct policies. If you even ask for any compensation for In game content they can ban you for life, for violating their policy. Seeing as Microsoft owns Xbox Live and now Minecraft pry not the best idea to get yourself on their naughty list right before Christmas.
Happens alot on Madden Ultimate team, guys rent out players for "donations"... then get their accounts frozen over it. Really not worth it.

I had a buddy of mine a few years back whom would ask for small donations and in return he would farm you 10 red runes in a game called Too Human. These runes would take HOURS and HOURS to find and collect, anyhow point is after about a month of doing so his account was terminated and his console banned from xbox live for the sole reason that he was in breach of M$ TOS.
Granted your providing a service, where he provided runes, but when you get right down to it; pretty much the same thing. Bottom line is tread very carefully.

Unless the MC console version displays the Mojang EULA, the Mojang EULA cannot apply to the MC console version. For the simple reason that the player wasn't informed and thus given the opportunity to agree to it (by clicking a button or not playing).
However, as Cire360 and somebody else pointed out that Microsoft's EULA forbids making money and the player has most definitely been presented with the MS EULA and opportunity to accept it.
Given that MC PC Servers integrating with money and handing out rewards are an automated thing that's been around for awhile (and always was in violation of the EULA), the console version really just rode on the coat-tails of the MS EULA anyway. No console game that I am aware of presents the user with its own EULA.
I can't speak for Microsoft or Mojang, but the forum policy is this: Server advertisements in violation of the EULA are not permitted, period. For example, you can't offer a chest of goodies in exchange for a $10 "donation". So all else aside, if we find (or have reported) any such server, at the very least the post will be modified or removed.
