1) If you ran a faction server, how would you plan on making money?
2) Don't you think that minigame servers like mineplex will thrive in comparison, since there is a lobby and therefore good time to show off your particle effects? (Honestly, I thought about donating to mineplex the other day, but I don't want to do per-month)
3) What gives mineplex the idea that they can only "rent" ranks (as in, pay-per-month), instead of sell them permanently?

1). I wouldn't. I can host a server for the cost of a WoW subscription (and you don't see people asking for donations to buy a WoW subscription). The point of a server is to not make money, but to run a community. If you happen to make money out of it then great. But do not think of server running as a business. You -will- be running in Red most of the time. If you do not like that idea, then you are in the wrong sector. People have been running servers for games long before "donations" were a thing, so it is possible to do.
2). Mineplex is too big for it's own good. Without all the donations they were getting, they will crash. The only servers I can see surviving are ones that are specialised and economical. It is impractical now to have a dozen worlds, infinite map, and hundreds of players. So any server like that, will have to close their doors.
3). Ignorance. When the anvil comes, Mineplex is big enough to be on Mojang's radar as a giant to topple down. They, along with WoodyCraft and Hypixel would be the ones most likely to face legal trouble if they do not comply with the EULA.
Anyhow, me and my bro thought up some ways people could make money in a sort-of pay-for-gameplay-features fashion, but they're all either very "light" or more annoying than advertisements. Please tell me:
a) Whether you think they would be a viable way to support the server
Whether you think the eula technically allows them
c) Whether you think they're mean
d) Whether you think notch would be ok with it
1) The "vote-to-play" method. After the first day, you have to vote to log on, unless you donate. Not really pay2play!
2) The "booster" method. Based off of mineplex's gem boosters (which have been changed to be compliant with the eula), this gives the donors the ability to type "/gift" once for each day you've been a donor. /gift gives everyone online money, or if you prefer, a "premium currency" of sort. The donors could choose whether to /gift when tons of people are on, or they could make a "gift guild" who all type /gift while each of them were on. As long as you had the premium currency prices pretty high, this might just work. The best part is that the less donors there are, the more this encourages them to donate (as they are getting less premium currency from others' "/gifts"), so your server wouldn't be able to become a large p2w server, but it would be able to survive.
3) This next one is hilariously pay to win and incredibly annoying to free players. I call it "Perk Time!" Basically, at a certain time, say 6:50-7:00PM fridays UTC, everyone except donors is kicked from the server. During this time, the server owner can legally give any rewards they so choose to the donors, because they are the only ones on the server. This is really the most pathetic loophole I've ever seen. The only financial problem with it is the fact that you are kicking all free players, but you still have to pick a time that most donors will be able to join at.
Without seeing the EULA itself, I cannot give you an exact answer but:

mojang did ot make these changes to make realms grow. realms isn't for large servers. realms is mainly for kids who want to set up a small server with little trouble.
So what do you suggest then? What is your compromise to punish the bad apples while keeping the good? For Mojang to go through each cape uploaded (over a million) and check to see which ones are knock offs?
My solution is for them to not care and let every one have capes if they want. I'd bed my life that there were more people who had the capes mod than ever went to mincon. The people at mine con threw more money at mojag though so forget the people who dont have the money/care to goto minecon.

If Mojang wants Capes to be something rare and unique, then it is their prerogative. Until Minecraft goes open source, Mojang can continue to guide Minecraft into their ideal direction.
Don't get me wrong, I like capes. I see Mojang's reaction was overkill, but overkill is the only way to kill something online sadly. R.I.P Cape mod.

That didn't answer my question, so I take it Capes are CLIENT Sided, meaning no one else sees them except you, yourself. So what's the point?
