Basically it implies that you'll at least need the mod author's permission first.
"You may not distribute any Modded Versions of our Game or software, and we’d appreciate it if you didn’t use Mods for griefing. Basically, Mods are okay to distribute; hacked versions or Modded Versions of the Game client or server software are not okay to distribute."
It says nothing about not making modpacks nor distribution of it. It specifically states there that you cannot distribute Micorosoft's code in any way even modded.

I took a look at the witchery source, and I don't think it's the copyright that's holding people back from updating it, it's just kinda complicated and feels all over the place. Well, that's how I feel anyway.

Did you read the proof of the main thread? Now Microsoft directly gives you to modify distribute so on and so forth to them and the user. I don't think it use to be like this but, nobody must of read the changes it use to say mod owners have some permission restrictions but, now it's like by giving this to the public you realize it's going to be redistributed against your will and modified against your will. Love it that's how it should be
If you like witchery mod why don't you update it then? What happened to the original user sounds like a 1.7.10 dev that might be working on 1.10.2 or 1.11.2 or 1.12

Did you read mojang's EULA? It clearly states otherwise I have to report you for trying to falsely report me I am legit sorry. Also no direct permission was made so by your rules it would have been taken down. Again it clearly stated you have a right to redistrubute for users and mojang there is no argument. They are saying you may have your own EULA if it's not too long(read their EULA) and if it corresponds to their agreement stated above.

Well did you read what the EULA said you may have your own license but, it has to corresponds to mojang's EULA which specifically states you may re-distribute and modify for users and them. It also said don't make it too long they don't like reading documents.

I think you all need to stop fighting about this. If I person really loved a mod so much that they spent their time updating it (which is not easy to do), then let them. If the original mod author has a problem with their mod being updated for free for them, then let the author file the complaint. Getting mad over an idea just because you want to be right is pointless >.>

This is at the content section head not hard to find. I assume you don't know how to find the content section go there and hit control + F then find content.
This is final it's their agreement not the mod owners agreement in order for a mod to have a license and be a mod it must fallow this EULA. So yes it is "their" content but, it can be modified aka updated, distributed aka on the mc forum to do the main function of this thread.
