Notch wasn't trying to copyright any sort of word, Bethesda was pressing charges- they were the ones trying to 'copyright it'. Oh, and this is old news.
A lawsuit based on the word "Scroll(s)", eh? I honestly think that Mojang should and will win this lawsuit. First of all, unless they coined the term, they don't own it. And I'm fairly certain that they never coined it in the first place.
Second of all, they really aren't affected by this. You could search for the fifth game by searching with the word "Skyrim", not "Scrolls", so they probably wouldn't be affected that much.

Zenimax is simply trying to cover their own arses. I'm sure you would too when you have millions of dollars in revenue at stake over a trademark. And FYI to the article writer at Kotaku, when you apply for a Trademark you pretty much want to size up the article to EVERY facet of the word, why would you not want to own the rights to a potential commercial on tv for your game? and how is it that Zenimax even has the capacity to loose their copyright over Elder Scrolls?

the two have different titles, One, Mojang should apply strictly for a copyright specifically one word titles for their game Scrolls, and then any sub title thereafter for Scrolls 2 and the like, then Bethesda should refile for a Copyright over the term Elder, Scrolls, and any combination of the two in any title, BUT not if the title ONLY contains the word scrolls, or is lacking Elder in the title.

If they loose it'll be good, Mojang deserves to win. Game store and Game station dont sue each other so why should scrolls be sued by elder scrolls? it's just ludicrous and I really will be devastated if mojang takes a defeat.
