A cursory browse through Google reveals games named "The Dead Sea Scrolls" and "The Lost Scrolls". If Bethesda doesn't similarly respond to these developers they seriously weaken their case against Mojang. Trademark law requires the registering entity (Bethesda) to reasonably protect their trademarks. Personally, I see way too many "Scrolls" out there for Bethesda (or anyone) to claim trademark infringement on that word alone. And it's about time that the Trademark Office stops handing out trademarks for common words. You should have to make up a word in order to own the rights to it. In any case, if you trademark "Elder Scrolls" you should only own that combination, not the two words that comprise it.
The difference is those games didn't apply for trademarks.

Alright I've been thinking. When Bethesda tries to sue Mojang again... Dont support Bethesda! Make everyone support Notch! I don't want your games and what am I gonna do to them? Similarly, TSR once trademarked the words "Dungeon" and "Dragon" and wouldn't let people use them in their games until several costly legal battles reversed that bullying. And they made a game called "Dragon Quest", after Enix's game already existed in Japan, and wouldn't let them name it that in the US, hence why "Dragon Warrior".

That doesn't seem right. As I understand it, you can't copyright a single word (unless you created that word). The word "Scrolls" was certainly not created by Bethesda Softworks. Now if Mojang's new game was called, "Oblivion Scrolls" or something of that nature, it would be a different story. However, I'm not sure how the copyright works on Mojang's end. He certainly can't copyright the title.
This sounds like bullying to me though. Mojang blew up with minecraft but it's still an indie company and they're still the little guy. So it sounds like Bethesda Softworks is using this "scrolls" nonsense to try and stamp out future competition. That might be reaching but there is no way to confuse the two games. I never gave the "Elder Scrolls" series a thought when I heard of Mojang's new game. If anything it would make people think about the Elder Scrolls games and go buy and play them, not think, "derr Bethesda created a new game called 'Scrolls' hyuck!". Something just feels fishy about this whole thing.
