Setting aside the current rules, there is something that bothers me way more than donor perks. Voting incentives. With donations, the point is usually to keep the server afloat, but the voting stuff is just a way to artifically boost a servers ranking.
If I create something in Minecraft (say, a large citiy) and I choose to sell that creation there isn't jack squat Mojang can do about that - it is my creation - not theirs.
Actually, Mojang would have the rights to do something, they clearly stated NOT to make money off of their game in the EULA.
So basically you can charge people to join but not to get items?

Java programs are able to run on Windows, Linux and Apple os all at once, which means Minecraft too.
xBox, ps3 and iPod / iPad / iPhone versions have to be completely recoded however. xBox uses xbla, ps3 uses whatever ps3 uses and ios uses command C, or C#, whichever is right. I've never cared for ios development so I forget.

Servers cost, players pay, staff works to keep server updated: plugins, gameplay, world etc, even if staff takes some of the money they deserve it for their hard work. To those of you saying "If I make a mod I'm not allowed to sell it". You are allowed to sell content that you have made. If YOU wrote a bukkit plugin you are allowed to sell it. It doesn't matter if it relies on Mojang's code or not. Minecraft relies on Microsoft's or Apple's code. With out their OS Minecraft wouldn't be able to run! But Mojang can still sell their game with out being sued by Microsoft or Apple you can sell your code with out being sued by Mojang... That's how it works. Say you write a plugin that displays very nice particle effects over bow shots. You can sell that to players in game.
No, actually you can't sell mods nor plugins.
Go read Microsoft and Apple EULAs, you'll understand better how Mojang can make money.

Mojang has lots of developers. And everyone needs to chill out. If me, the lowly LDX, can run a server for 7 months without a cent of money from rank purchases and donations and junk, surely these rich 30-year-old server owners can quit scamming kids and host their server for free, am I right??

I usually just lurk here... But on this issue, I feel the need to speak out.
The EULA hasn't changed for MC for quite a long time. The part that restricts sale of in-game items or 'perks' of content that Mojang has created has always been there.
Just like back in school, there was that one cool teacher that didn't mind if you chewed gum in class, despite the rule against it. So you chewed your gum. But that one guy in the back kept popping bubbles loudly. So the teacher stops ignoring the gum, and makes everyone spit it out. You have to do it. The rule was there from the start, but only enforced when someone pushes things way too far.
Another analogy, Going down the highway at 5-10 mph/kph over the speedlimit. Usually a cop won't pull you over for that. But when they do, you don't argue that they were doing anything wrong, you take your ticket and get over it. YOU WERE SPEEDING!
The rule has been there. We were all aware of it. You had to click the "I Agree" button.
DO NOT lash out at Mojang. Take your anger out on the guy in the back popping his bubbles.
Edit to add: Also, I was the Admin/Host/Operator for a prominent niche-gaming community's official MC server. I started out paying for everything out of pocket. Roughly $100 month for this. Sure it was a small server, but that's still $100... per month... After the third month operating it, I asked people, "Hey, would you guys mind helping me pay for this server?" And you know what the overwhelming response was? It wasn't "What's in it for us", it wasn't "What are you gonna give us" it wasn't "Am I gonna get loot". The overwhelming response was "YES". Not only did I get enough funding from PURE DONATIONS to run the server for another full YEAR, but also to upgrade the server significantly and turn it into an amazing platform.
A good server CAN operate without SELLING items or perks. At the end of my server, I was running it at about $450 a month, on pure donations. I paid nothing out of pocket. I gave no perks to the players. They gave funding because they loved the server I provided.

Large servers: Have thousands of people on at any single time. They can easily make ends meet with out selling Mojang's property to players. *Advertisements, patron, donations*. Also by the looks of it Mojang is looking to amend what they're looking at as "selling content" so people can sell things like flashy particle effects, nothing too final yet though.
Some Medium servers: Can Survive with Donations easily.
Some Medium servers will not be able to make ends meet and will close. Players can simply switch over to any of the other dozen servers exactly like it!
Small servers: You know you can host a small server on your computer for FREE right?
And if you REALLY don't want to host it on your computer, BeastNode offers a dedicated server which can host ~12 people at a single time for just $5 a month. If you honestly can't come up with $5 a month, then hosting a server is the least of your worries.
The biggest problem is people seem to think that in order to have 10 people on at a time they need a $50 a month server. That is simply not the case. A pvp server *with a custom map* can host hundreds of people on a $30 server with ease. If you can't get hundreds of people then you should innovate and make your server different from the literal thousands of other servers exactly like it. If you can get 500 people on a medium sized server, then asking for donations shouldn't be a problem.
A server isn't for everyone. While Mojang gives everybody the opportunity to make a server, not every person should have one.
In order to use OpenGL you need to create a rendering context which uses the OS windowing layer. That is why on a windows machine the game looks like it belongs on a windows machine, where as on a mac it looks like it belongs on a mac.
Creators of OpenGL have to make it compatible with all the operating systems and in order to do that they require access to vital controls which are only supplied by hardware drivers, and software developed by the OS manufacturer.
I've been looking into this issue more deeply, as when I first got into MC, I don't remember donors and perks being a big thing like they are now. And I have to be very, very honest as an experienced gamer and a person with a lot of life experience with not nice people:
Many of All of these perk system on servers that I've looked into make me wildly uncomfortable, even ones that are being promoted by microcelebrity You Tubers that I otherwise like. I personally would not want to be on a server with one of these systems. In the very least, it's potentially game-breaking, this is, ruins the game for anyone else who isn't buying into the perk system, and encourages otherwise honest server owners to do some dumb things that are damaging to the community. In the worst, it's just a feast for scam artists and grifters to take advantage of dedicated fans, especially younger fans who by no fault of their own don't know better.
If I was in any way associated with Mojang, I would certainly feel the need to step in and draw some clear lines and work out something with server owners, to protect the product both legally and as a business venture. And that is ultimately in the best interest of the community as well. I don't think anyone either on the business end of MC or on the fandom end wants this community to become associated with rip offs and shady server perk systems. Anyone who's been a gamer for a while know how that can happen, and how it has happened with other games.
The truth is it's very hard to verify the trustworthiness of any server owner as it is now. Unless this person is a longtime buddy of yours and you can personally vouch for them, you really don't know that person or their motivations. If Mojang sets down some rules that server owners have to agree to, then at least we'll have a bar against which to measure them. And maybe this won't make everyone happy but personally, I don't want to start hearing stories of people donating and then logging on the next day to find the server down and the owner unreachable, and then a few months later a suspiciously similar new server and server owner opens up and starts asking for donation. Because if that's not already happening, it will. Human nature is very predictable like that.
But please, if you want to explain to me how Mojang being shut down by legal threats is better than slicing down a few servers' incomes, then go ahead, I'm all ears.

After that he received at least 5 times more than he needed to provide salaries for his developers for years. Everything after that was pure profit. All that porting to consoles for extra cash, overpriced t-shirts and now realms (FYI it looks like they are about 2x more expensive than private minecraft hosting and they don't even provide the same service-plugins).
I supported notch and the first stage of mojang when they were indie and actually worked on the game and listened to the community but right now i just cant. They failed to keep their promises and add very simple things that were hugely requested but can't will surely grab on the first easy money they can find.
Reading some articles (Don't know how true this is) "Mojang makes around $350,000 every day just from the computer release. Let's even say their company has 100 members, that'd be 3500 euros a day for per a company member.. Shouldn't it be about 2000 euros per month? Not 105000.. Oh and i also found an old pic where notch actually allows people to pirate the game, clearly showing no signs of greediness unlike now..
Here on minecraft forums EVERYONE hates cracked players for no reason (i was cracked for 2 years until i got my first credit card, even though i was a dedicated map maker i received a bunch of hate. As soon as i got my credit card i bought minecraft because i wanted to support it)
Don't know what happened but now he is mad at servers for being p2w or p2p or even just purely f2p with only cosmetics as a buyable option..
2)I can't say anything about legal threats because that's not my area, all i know is that terms of service should protect them and that servers have nothing to do with mojang and are two different things.
TLDR: Company makes a billion more than they need, nobody cares, 1000 people each make 200 euros and everyone loses their minds..
To solve problem;
1) Make something like an IAP system that uses a central list of prices
2) You buy item at price determined by Mojang & Community
3) Server gets all (or say 99% of) the money from purchase (Mojang takes tiny cut to cover cost of system)
If something is not registered with Mojang's list of prices, you can't buy it. In this situation, mod maker or server owner sends request to have it added. By default, you would have all vanilla stuff, and all really popular "loot", which would keep most server owners mostly happy. Adding a few key things for the more popular mods, like Copper, Tin, etc, would not be very hard. When this isn't enough, you can send a request in for it to be added.
Optional - Server has a price range. Specific server owners could be given more freedom with prices at the discretion of Mojang [application accepted/denied system?]
Result - Server owners can still sell content, but their selling ability is determined by Mojang & the community as a whole. If you have a good server, Mojang will let you charge more. If you're a bad apple and try to charge 1000USD for a pickaxe that never breaks, they can tell you to get lost and force you to charge a reasonable amount.
I mean, it is quite clear that Mojang is a "good company". They might be lazy. They might want money like everyone else. However, they seem to genuinely care about the community, and I honestly believe that they are going to be trying really hard to not mess things up for anyone (if not solely because they realize that this attitude humanizes them with the community and is partly responsible for the massive popularity of the game, and huge profits of the company). Unfortunately, their typical "do what you want" approach just doesn't seem to be working in this situation.

Ok... I'm gonna just break this down.
1: Companies exist to make money. That's just a fact. If there were no profits, none of these things would exist in the first place.
2: Mojang EARNED every penny of sales that they've gotten. Notch created an amazing game that appealed to an almost un-tapped market and did it WELL. Jens is now leading the project and continues to do a bunch of good work on it.
3: No where in any of this did Mojang say they want a cut of those sales. They don't care about someone getting paid. What they've spoken out against is servers selling parts of their game at outragous prices to people. Mostly, to kids who are using their parents' cards without permission.
4: You appear very ignorant of basic marketing dynamics, and about the situation as a whole. Stop listening to trolls, Stop getting your information from the Rumor mill, and try doing a little bit of digging into the facts of the situation before spouting nonsense about greed.
This affects the servers that are barely making it from donations that are for packages if mojang was smart put a limit on how much a package can be set like $500 or something I mean the reason why they are doing is because some stupid kids steal there parents credit card and buys stuff and that's how this happened... I mean come on lets be real mojang this is a dumb decision, here are the reasons.
1.) Servers that were making hand over fist with money will not get as much money because they are only getting money from selling packages (items) and it will get the server fallen.
2.) The servers that are barely making it will crash and fall because they wont be able to sell items.
I mean why cant we do this, these are our freedoms of selling stuff and there jacking it up.

voteing helps server way more then you think it brings in more players more chances someone would donate
I run a vanilla server vote rewards were next to impossible with out running bukkit but i figured a way with out modifiing mojang jar and or using modded software now my server gets alot more votes mind you i give flat out just plain old fish cause hey you want diamonds go and mine them. and fish dosent effect vanilla gameplay that much icould have it give nothing and just send a telraw say woot someone voted please do same but hey.
so i dont see a issue with that as its built to help servers not hinder them if your too lazy to vote or dont want to vote thats your problem its free easy and dosent stop you playing the game
now if vote sites sold extra votes modifed the server string to say paid-vote allowing server owner to reward based of a paid vote - and have ethat money goto a server owner all they need do is make a listner to notice the paid-vote string and give something else maybe a token they can use ingame that be unfair and also a sneaky way to bypass shops and items directly, i think it would still breach the uela
as mark said charge people to access server nothing against the law doing that make it a sub give everything for free make bonuses based of vote rewards ethier ways there is ways around this want to make them pay to be unbaned easy dont ban via minecraft ban via ip through your box firewall make them pay to have you re allow them in via iptables. instead of minecraft

Its not hard to make money for you server to survive, using your server as a cash cow is wrong.
Iif you make a beer here and there awsome but most money should only ever be put back into server not your pocket.
My server i rely just on donations and even then im still forking out of my pocket ( thats cool i provide a strict rule set and try give a nice enviroment for kids to play ), yes sometime i will change the color of someones name as a thankyou but there is no garrenttee they get that, it could still not be given. People donate to my server cause they enjoy it want it to run longer and to help me not fork out bulk money running a dedicated system cause mojang jar is so laggy trust me as a vanilla server owner block lag is still a big issue even with a e5 65gig dedicated machine+ ssd. still get block lag and i only can run 40 slots go figure you modded server owners have it easy compared to us vanilla beans.

In order to use OpenGL you need to create a rendering context which uses the OS windowing layer. That is why on a windows machine the game looks like it belongs on a windows machine, where as on a mac it looks like it belongs on a mac.
Creators of OpenGL have to make it compatible with all the operating systems and in order to do that they require access to vital controls which are only supplied by hardware drivers, and software developed by the OS manufacturer.
Many ofAll of these perk system on servers that I've looked into make me wildly uncomfortable, even ones that are being promoted by microcelebrity You Tubers that I otherwise like. I personally would not want to be on a server with one of these systems. In the very least, it's potentially game-breaking, this is, ruins the game for anyone else who isn't buying into the perk system, and encourages otherwise honest server owners to do some dumb things that are damaging to the community. In the worst, it's just a feast for scam artists and grifters to take advantage of dedicated fans, especially younger fans who by no fault of their own don't know better.If I was in any way associated with Mojang, I would certainly feel the need to step in and draw some clear lines and work out something with server owners, to protect the product both legally and as a business venture. And that is ultimately in the best interest of the community as well. I don't think anyone either on the business end of MC or on the fandom end wants this community to become associated with rip offs and shady server perk systems. Anyone who's been a gamer for a while know how that can happen, and how it has happened with other games.
The truth is it's very hard to verify the trustworthiness of any server owner as it is now. Unless this person is a longtime buddy of yours and you can personally vouch for them, you really don't know that person or their motivations. If Mojang sets down some rules that server owners have to agree to, then at least we'll have a bar against which to measure them. And maybe this won't make everyone happy but personally, I don't want to start hearing stories of people donating and then logging on the next day to find the server down and the owner unreachable, and then a few months later a suspiciously similar new server and server owner opens up and starts asking for donation. Because if that's not already happening, it will. Human nature is very predictable like that.

1)There is no possibility of a company being greedy, they already are, if only someone could explain me where the millions went and who took all the money, i don't think even 30% went to actual game development and other costs.
While some servers maybe got a few bucks out of running their server, mojang is bathing in cash. They didn't make a game that required hundreds of developers and 5mil to fund, the base game was made by 1 guy in a few months. After that he received at least 5 times more than he needed to provide salaries for his developers for years. Everything after that was pure profit. All that porting to consoles for extra cash, overpriced t-shirts and now realms (FYI it looks like they are about 2x more expensive than private minecraft hosting and they don't even provide the same service-plugins).
I supported notch and the first stage of mojang when they were indie and actually worked on the game and listened to the community but right now i just cant. They failed to keep their promises and add very simple things that were hugely requested but can't will surely grab on the first easy money they can find.

Here on minecraft forums EVERYONE hates cracked players for no reason (i was cracked for 2 years until i got my first credit card, even though i was a dedicated map maker i received a bunch of hate. As soon as i got my credit card i bought minecraft because i wanted to support it)
Don't know what happened but now he is mad at servers for being p2w or p2p or even just purely f2p with only cosmetics as a buyable option..
2)I can't say anything about legal threats because that's not my area, all i know is that terms of service should protect them and that servers have nothing to do with mojang and are two different things.
TLDR: Company makes a billion more than they need, nobody cares, 1000 people each make 200 euros and everyone loses their minds..
1) Make something like an IAP system that uses a central list of prices
2) You buy item at price determined by Mojang & Community
3) Server gets all (or say 99% of) the money from purchase (Mojang takes tiny cut to cover cost of system)
If something is not registered with Mojang's list of prices, you can't buy it. In this situation, mod maker or server owner sends request to have it added. By default, you would have all vanilla stuff, and all really popular "loot", which would keep most server owners mostly happy. Adding a few key things for the more popular mods, like Copper, Tin, etc, would not be very hard. When this isn't enough, you can send a request in for it to be added.
Optional - Server has a price range. Specific server owners could be given more freedom with prices at the discretion of Mojang [application accepted/denied system?]
Result - Server owners can still sell content, but their selling ability is determined by Mojang & the community as a whole. If you have a good server, Mojang will let you charge more. If you're a bad apple and try to charge 1000USD for a pickaxe that never breaks, they can tell you to get lost and force you to charge a reasonable amount.
I mean, it is quite clear that Mojang is a "good company". They might be lazy. They might want money like everyone else. However, they seem to genuinely care about the community, and I honestly believe that they are going to be trying really hard to not mess things up for anyone (if not solely because they realize that this attitude humanizes them with the community and is partly responsible for the massive popularity of the game, and huge profits of the company). Unfortunately, their typical "do what you want" approach just doesn't seem to be working in this situation.

Ok... I'm gonna just break this down.
1: Companies exist to make money. That's just a fact. If there were no profits, none of these things would exist in the first place.
2: Mojang EARNED every penny of sales that they've gotten. Notch created an amazing game that appealed to an almost un-tapped market and did it WELL. Jens is now leading the project and continues to do a bunch of good work on it.
3: No where in any of this did Mojang say they want a cut of those sales. They don't care about someone getting paid. What they've spoken out against is servers selling parts of their game at outragous prices to people. Mostly, to kids who are using their parents' cards without permission.
4: You appear very ignorant of basic marketing dynamics, and about the situation as a whole. Stop listening to trolls, Stop getting your information from the Rumor mill, and try doing a little bit of digging into the facts of the situation before spouting nonsense about greed.
1.) Servers that were making hand over fist with money will not get as much money because they are only getting money from selling packages (items) and it will get the server fallen.
2.) The servers that are barely making it will crash and fall because they wont be able to sell items.
I mean why cant we do this, these are our freedoms of selling stuff and there jacking it up.
voteing helps server way more then you think it brings in more players more chances someone would donate
I run a vanilla server vote rewards were next to impossible with out running bukkit but i figured a way with out modifiing mojang jar and or using modded software now my server gets alot more votes mind you i give flat out just plain old fish cause hey you want diamonds go and mine them. and fish dosent effect vanilla gameplay that much icould have it give nothing and just send a telraw say woot someone voted please do same but hey.
so i dont see a issue with that as its built to help servers not hinder them if your too lazy to vote or dont want to vote thats your problem its free easy and dosent stop you playing the game
now if vote sites sold extra votes modifed the server string to say paid-vote allowing server owner to reward based of a paid vote - and have ethat money goto a server owner all they need do is make a listner to notice the paid-vote string and give something else maybe a token they can use ingame that be unfair and also a sneaky way to bypass shops and items directly, i think it would still breach the uela
as mark said charge people to access server nothing against the law doing that make it a sub give everything for free make bonuses based of vote rewards ethier ways there is ways around this want to make them pay to be unbaned easy dont ban via minecraft ban via ip through your box firewall make them pay to have you re allow them in via iptables. instead of minecraft
there is many ways you can make money with minecraft if your smart and clever that dose not technicly breach there uela
Its not hard to make money for you server to survive, using your server as a cash cow is wrong.
Iif you make a beer here and there awsome but most money should only ever be put back into server not your pocket.
My server i rely just on donations and even then im still forking out of my pocket ( thats cool i provide a strict rule set and try give a nice enviroment for kids to play ), yes sometime i will change the color of someones name as a thankyou but there is no garrenttee they get that, it could still not be given. People donate to my server cause they enjoy it want it to run longer and to help me not fork out bulk money running a dedicated system cause mojang jar is so laggy trust me as a vanilla server owner block lag is still a big issue even with a e5 65gig dedicated machine+ ssd. still get block lag and i only can run 40 slots go figure you modded server owners have it easy compared to us vanilla beans.
