Yes it is, when you boot up your server you will even be prompted to agree to the EULA by replacing the "false" with "TRUE" and within is the link to it in that EULA.txt file as well.
Yes there will always be a EULA however, if you are asking if the most recent updated one is still in effect then no. When Microsoft bought Mojang they reverted back to the previous EULA from December 2013. You can view the most current EULA here: https://account.mojang.com/documents/minecraft_eula

One thing to say, The EULA didn't effect until 1.7.10, So you would think that 1.7.9 is EULA free even through it doesn't generate the EULA.txt file. Well you didn't find a loop hole. EULA effected every version of 1.7 But on the EULA.txt generates in 1.7.10 Up, Which doesn't mean you are free of the EULA with 1.7.9
The EULA rules never changed since December 2013, just, everyone freaked out when Mojang advertised that the EULA does ban the selling of in-game items. This has pretty much always been a part of their EULA.
The EULA has been in place for a while now. Mojang claimed they were going to start enforcing the EULA to stop a "pay to win experience" but nothing has actually happened yet. The only thing I've seen changed was the prompt when you first run your server.

I think mojang should start enforcing the eula. I have reported a dozen of servers. 20 to be exact. Most of them with 100+ players. Mojang has done nothing nor have the offending items have been taken down. I personally dislike these servers that have greedy owners. They earn more than enough frm the donations to pay their hosting bills. What is this then? The owners are getting greedy.
It's not solely an issue of greedy server owners. I like pay to win because as an adult with a job when I want to build a massive fortress I don't have the time to devote to mining all the stuff necessary. I much prefer donating $20 or so for in game currency then buying the materials I need at the server's shop. A castle I built recently used 27,641 stone bricks. Having to obtain them manually would take quite a lot of time.

Those servers may make more than enough to host the server, but you don't know that they aren't spending that money on their dedicated hosting (can cost hundreds of dollars a month), website hosting (again can cost 20-50 dollars a month), possibly paying staff, developers, and graphics designers can also be costly. Even if they make more than that (which I doubt the servers you reported were) then you still don't know what they're spending the server money on, they could still just be paying the server off monthly with it.

My point exactly. I personally am too strict on spending donations solely on the server, but that's just me being weird. And yes, people who put work into servers deserve to profit the same way Mojang deserves profit for putting work into making the game, it's only fair. But unfortunately that just isn't the way it works :S

Nup those servers make a lot of money each month. And they already have graphics.etc. What I'm really unhappy about is that servers are selling unbans, paying money to get unbanned is just unreasonable. Technically, they shouldn't be making any profit as most of the plugins that the servers I visited have are public plugins from bukkit.org. Instead they should be donating to the author who made it. Pay to win is ok but I'm talking about unfair advantages such as you getting a machine gun in paintball and speed 5. Besides that some servers limit who can go where on their servers, now I'm not talking about development servers where only staff are allowed. I'm talking about servers where you have to donate.etc to be able to play on it.

I currently have a Minecraft server, so i'm hoping its void so that I will be able to pay for the hosting.
