As opposed to Mojang attempting to claim ownership of one word?

Or when somebody concisely explains what the hells going on, all the first post says is *they are sueing them for using the scrolls name and they wanted to play quake*. Well im not saying that bethesda has a right to have a law suite because of "scrolls" which is a common word. But it was coming to notch, he should have expanded (hired more people) not like he's a millionaire or anything (sarcasm). More people, more game production, more game production more games!, more games=more money coming in, and they wouldn't be the "little guy" and perhaps they would be suing bethesda on something ridiculous. And in a sense of karma notch has gotten lazy with development.
Bethesda, you have done something beyond bad.

I am going to make a game called "TES". It will stand for TheEpicScrolls. It comes out 11.11.11. You think I will get sued? I have this great idea though, it's open world. Am I doing good with it so far?
I am making other games too, like this one where you carry a gun in a first person perspective, but i am afraid I might get sued, because the first person perspective-the idea is already taken. So...hrmm..maybe third person? idk. Is FPS trademarked? O know, now i am giving them ideas.
I don't know why Bethesda insists that a word is something to sue about. I can kind of see where they are coming from, Scrolls and Elder Scrolls, but I don't think anyone would really mix them up.

Wow, there's so much hyperbole and talking without knowing all the facts here. I read the kotaku post and all it gave me was a snippet of the alleged trademark and a lot of unnecessary vitriol toward notch. These things are easy to take out of context and I would really like to be able to see the whole thing before making any judgments on it.
However, for my own biased opinion, I prefer Mojang. I played Morrowwind and it kinda sucked. I also played Oblivion and it was sort of better, I guess. The Bethesda games I've played are nothing to write home about. I would choose Minecraft over Skyrim any day simply for the fact I'll get a lot more mileage out of it.
The excuse that Bethesda "has" to protect its own ass due to enforcing its own branding seems more of an argument against the trademark system than Mojang. Words...sheesh.
Protip: get the whole story before claiming anathema on anyone.

Hey guys, I think it is really important that Notch changes his game title before he gets into trouble with bethesda, clearly bethesda can't let this pass since the name scrolls could very well be confused with the name elder scrolls, if someone would walk around the video game store he might buy the game scrolls whilst thinking it's a work of bethesda softworks studios, now don't think of it as how you would react, cause obviously you are aware of the two titles, but think of how someone who never heard of mojang (a lot of freaking people!!!) would react to a game called scrolls, he really might get confused, I'm not even mentioning the part of the trademark problem because the trademark that mojang was trying to recieve was refused, and of course it is the most problematic, and even changing the name to scrolls: (something) might still be confusing, I personally think notch should change the title, to all the other people who posted on this post, I'm sorry I didn't read your post, but I really think you should support me in the cause of helping notch realize that bethesda won't back down and a judge could very well decide bethesda is correct and that mojang should compensate bethesda, I don't like seein the companies responsible for two of the only games I bought (I don't buy a lot of games) fight over something that should be resolved by notch changing the title of that game... that is my opinion and as much as I'm cocky about this I think this post should be read by notch, cause I really am concerned for him. and sorry that the post is so long...

Then anything that follows is on his own head. Mojang does NOT have the power to fight large publishers like Bethesda. Who happens to be in the right DOES NOT MATTER HERE. Mojang can't afford to fight a giant at this stage in its life. Notch needs to back down or he'll be smashed underfoot, and all the PR damage he's managed to do to Zanimax won't mean jack-all if Mojang is sunk and this game dies as a result. The man doesn't strike me as a very good long-term thinker.

Look at the Pokemon series. It has cards, a game, clothing, and even a TV series. I think Notch is trying to do just that in the long run. So he doesn't really care what the name is, as long as he has all the rights to it.

This seems the most reasonable to me. I'm not a lawyer, but from what I've gathered on trademark laws, "scroll" refers to the brand, not the word itself. The reason it's in so many media types is because if notch wants to advertise in these mediums or produce brand merchandise, he can without people piggy backing on the project he put the work into.
Notch does strike me as a humble guy. He's been forgiving of piracy (even though, as a developer, he has the most to lose because of it) and has given away copies of his games, something a smaller company doesn't usually do and he's been very open to listening to the player base. I don't know Notch personally, but to think he would all the sudden turn into some greedy scammer seems highly unlikely.
