THIS IS TOTALLY A FRAUD! i mean look at this. its universal all over again. they tried to sue nintendo because donkey kong was similar to king kong. and what happened? nintendo found out that universal was just using this similarity to con the court to get nintendos money. i mean come on? just because their upcoming title has a word that is in your title is a valid excuse to sue someone? um reallity check, IT TOTALLY ISNT! if someone could report this to mojang that its probly just a con that would be great. i dont want to see minecraft go down just cuz of a stupid lawsuit over a SINGLE F**KING WORD! please support me. im gonna do some research and anyone who agrees should do some too.

ah yes the fight over companys about games because minecraft is VERY popular and better then all thier games put togethor and has 3mill sales they will sue us for saying hi bucause thats in the descripion of one of thier games.....sigh
Ugh... I love Bethesda games... and I was just on Fallout 3 and NV, but that isn't necessary for them to take the word Scroll. Hopefully they won't sue them because that would be just dumb for them to take down small time studio's...
I think the fact that there are 94 pages (so far) of people protesting this lawsuit suggests notch has no reason to consider a name change for the development. I don't know if this forum could be used as a defense in court, but it sure says something.
Maybe it can be changed to "Scrolls of minecraft" or whatever.
Just have a backbone Notch, don't let them walk over you like this.
I don't think that Bethesda has much of a legal leg to stand on here. As I understand it they'll have to argue that "Elder Scrolls" constitutes an Arbitrary Trademark, which would be difficult given that in-game lore establishes the name as a direct reference to an actual set of ancient scrolls within the fictional mythology (and so would be entirely reliant on their finding a court that is largely ignorant of the details of the case). Either that, or they would have to show that the term bears a demonstrable link in the public awareness to their products.
But it's worse than that...
They aren't even arguing that Mojang is infringing on the term "Elder Scrolls". Their entire case hinges on proving that the word "Scrolls" alone, a common English word with an existing meaning, carries the same weight and brand recognition as the full wording of "The Elder Scrolls". They are going to have to be able to prove that their player base recognizes their products as simply "Scrolls" games. Not to mention, they may have to prove that this recognition is greater than other usage of the term "Scrolls" in gaming, such as "Side Scroller" or the ubiquitous "Magic Scrolls" in fantasy games.
In short, Bethsoft is pretty much throwing money away to harass Mojang.
lol this just happened recently a website had a file for download called dulce report behind moon and paramount was trying to sue them over the words behind mooon cause of transformers dark side of the moon.....
gotta love legal departments. if anyone else here knows the manga im talking about as they were saying on the other site they can have fun explaining how they own it and how the 2 arent different as they review the material in question : P
I agree with everyone, Bethesda can't sue people for using the word "Scrolls". It's like suing someone because they didn't give you half their sandwich. Bethesda should stop whining about it.

Bethesda could "call off" their lawyers. They have control over their lawyers, and the head of the company could tell them to stop with the lawsuit.
