You can't copyright single words but you can trademark them individually if they are part of a trademarked IP. And it's not about using the word in common language, it's about using the word as title of a franchise in the same entertainment medium. That is where the claim becomes legitimate.

I find it relatively funny that a lot of posters here are acting like they know the legal system and they are lawyers. You have no idea what can be sued over. I'm pretty sure the lawyers over at Bethesda had some schooling and wouldn't sue over something they feel couldn't win, 1 its a waste of money and 2 makes them look like idiots.

It's sad that companies will sue over use of certain words, especially if they are currently used for a project name, as this may only be a working name. I am a big fan of the Elder Scrolls (DOH!) series. The word Scrolls (crap!) has been used for thousands of years before the first transistor was invented. Its even funnier that in most of the Elder
Scrolls (uh oh!) games there is a hardly enough reference to scrolls (whoops!) themselves.
Now does that mean that our Elder Scrolls (dangit!) company will be going after any other use of the word Scrolls (GASP!)? Most likely not. They are defending their use of the word Scrolls (oh come on!) as it references "their" game. Oh wait! They were not the first to use the word Scrolls (oh to hell with it) first in a game!
I just can't believe this. There are tens, if not hundreds of games with the world "Scrolls" in the title. This one has simply been ANNOUNCED. There is no proof that this game bears any resemblance to Elder Scrolls.
