It's fine how it is. There are no grounds to outlaw it in all of Minecraft, as some servers encourage it. It's up to the server owner to choose whether or not to outlaw it. It's also up to them to provide players with anti-griefing measures.
if its in a video game? no its not really all that important... just more of an annoyance. its really just vandalism in minecraft and trash talk in on xbox, ps3, etc.
even if its a swastika it doesnt mean griefing in video games should be illegal, its not like someone goes to your house in real life and spray paints it on there. imagine a little kid not knowing what he's doing/some one telling him to make one and he/she gets in trouble because its illegal (cant really get arrested when you are young). or if a teenager makes one in minecraft and someone reports him and he gets arrested? is that really fair?

Griefing is what immature 8-year olds do because they think it's funny and makes them cool. In truth it's just mean and brings no real gain to anyone. You shouldn't do it on a server that says no griefing (no duh)
But, if you go to a server that allows griefing, you asked for it. I find it lots of fun.
It was first seen in ancient Greek and Roman mythology. It was the shape of a god's throne (I dunno which one). It was a symbol of prosperity and good luck until the Nazis started using it. The Nazis made the swastika a bad thing. It originally was a symbol of goodness.
There will always be jerks in life. Depending on the circumstances, griefers may just be jerks in Minecraft. Except for guys like Team AVO. Those guys rock.
Griefing isn't necessarily done by 8 year olds. The human being craves to destroy, as much as it craves to create.

It was a metaphor; I don't mean that only 8-year olds do it. Doing it on a non-griefing server shows that you have the maturity level of one.
However, I don't think all griefing is bad, if a server allows it, go ahead and create mayhem to your heart's content. And, I do agree that people enjoy destroying just as much as they do creating.
If you're proposing that griefing be outlawed according to the legislatures in real life, I feel that you may want to rethink things. People (in America, at least, and in most places where Minecraft is a popular game), people have the right to express their opinion. You'll be bringing about a cancer that will destroy the freedom of Minecraft.
