After spotting a server that was p2p, I started to wonder, are servers that MAKE you pay THEM money to be on the server legal? They are using Minecraft server software,so It seems to me that would be illegal, they are making money off software they do not own the copyright to, I would compare it to say someone makes a mod, and uses it, thats fine, but then they they put out a chance for others to use it by paying Them, instead of the maker of the mod. Everyone who buys minecraft should be able to use it, if a server owner wants to open a server thats his decision, no one is making him make a server, Its not reasonable for the server owner to expect people to pay him to use Notch's game, even if its his server. To clarify I'm talking about mandatory payment to play on a server, NOT asking for donations, or even special perks for donating.

It's Mojang's content, but their service. So they're probably legal.
No it's not illegal. The Mojang ToS does not prohibit them from doing so. If they legally own the server that it is hosting(they pay the hosting service) they have every right to charge for it. Now will people be willing to pay for it? Probably not. Considering the many free to play servers out there.
They work hard to keep the servers up, trust me its a lot more work than it looks. they also provide the service of hosting the server for the players. and its not like notch cares.

Server owners own the server and can charge users to use their service. Mojang doesn't care if they do so it's perfectly legal. It may not be fair, but you don't have to use their service. You're not forced to use them.
They don't have to pay Notch anything to use that software unless he finds it a problem and adds it to the ToS. If the EULA/ToS actually says "You can't charge users to use your Minecraft Server" then it would be illegal. But it doesn't...
Do you know how much money it is to host a server? Then to pay out of your own pockets (especially if your poor and have a crappy internet)? It IS legal. The free ones out there will soon fall when they don't get donations unless they hosting it from there own computer. Alot of time and money goes into making a server.

No I dont know how much, But, necessity doesn't make things right. People do have the option of hosting from their own computer like you said, which besides electricty and internet would be just the same cost as playing minecraft in general. People also do not have to host from fancy expensive servers in other countries or states.
I'm not sure if the thread is around anymore, but I remember them putting up a pinned thread that said that complaining about pay to play servers wasn't even allowed. I remember this thread all the way back when I joined the forums, so I'm not sure if I can find it again.

But it is not their software to rent out. Seems like a big grey area to me. If so where is that topic now? Perhaps the forum admins thought it was also a question of legality, Would help if it was cleared up by Mahjong themselves, but i dont see that happening.

They are not renting out Minecraft's software, they are renting out their server. You already own minecraft software, they are simply renting out a server for you to play on. There is no renting out of Mojang's software. If it was a server that Mojang was hosting, then it would be illegal.

This topic is discussing whether or not pay to play servers are illegal so it wouldn't be breaking any rules. It does not say you are unable to charge for hosting a server. You are even allowed to sell mods for money, it turns out.
