It's not that, say for instance it Prot. 10 Diamond armor witha shapness 10 diamond sword...if that gets passed around then my players tend to get jealous and report the server...ad tha's really hurts me :/

hey i feel left out that so and so has a nvida titan and gets 1000fps and me here sitting with integrated graphics only gets 30fps now that is so unfair and leaves me out. Mojang is sticking it to me, the 1% (sarcasm)

Can you please point out somewhere official that if you "Donate" x-amount of money and you get x-stuff from it (like flying a name change and a kit) that IS or IS NOT the SAME as Selling the items. Because if you could it as the same (most likely) some servers don't get in trouble for letting people "Donate" hard currency for stuff like being able to fly because they thoult it was ok because it was a "Donation"
Yeah, perhaps OPARMOR is not the best example. But resources on basically anything but a PvP server get redistributed.

It's the same problem with the Trickle-down economics theory; you assume the resources get spread out between players over time, in reality they're usually kept and used by the person who got the resources. That's the case with resource and armor kits; I get a kit with potatoes in it, I don't distribute the potatoes, I plant them and farm them to myself, maybe after some time start selling them, but not likely. Even less likely for armor.

Based on the current information we have now..... Mojang can't sue everyone or even a lot of people.... They will most likely go to the top offenders and maybe leave really small servers alone... One of the only ways that Mojang could target servers, no matter their size or popularity, is through a reporting system.
I don't think Mojang has ever stated they would add a reporting system for the EULA, any hear if they would?

No no no. What I am saying is people should prepare for the worse. It is more of a case of Risk vs Reward. If a server owner completely focusses on fighting this and are not successful their server will die. If they attempt to adjust to this new EULA then they will be safer.
And who says not fighting here is worse? We aren't talking about some kind of world war. We are talking about a game. Ok. Maybe some server owners will loose their only source of income. But honestly if running a server is your only source of income you should probably play it safe and adjust because that businesses work . Although then again entrepreneurs are normally risk takers.
If people really want to stop this EULA then they need to think of alternatives that will still prevent Pay to Win servers because that is Mojang's main goal here. The best idea I have heard is having it so servers are required to obtain a license from Mojang in order to make money.
Hence, my opinion: I think Mojang overstepped the boundary just a little, not a lot. Remove the clauses on currency, modify the language on the restricted content to only apply to items and commands rather than areas or minigames, then everything would be perfect in my opinion.

2. Yes, definitely.
