I am staff for a creative freebuild server. On this server, we sell access to perks such as World Edit Access and teleportation access. We also have ranks you can build for called build ranks. We also limit perks to each build rank. Such as:
Artisan get /nick, but anyone below Artisan does not.
Mason gets water access, and anyone under Mason does not.
These perks are because of griefing and lags, such as redstone lag machines, and using only one bucket of water to cover an entire build with water.
Please quote from me and explain to me if any of this is illegal by this new Amendment to the EULA

Also, I had the question for World Edit, which is not such a thing of cosmetics, rather it speeds up the building process.
New servers have to be innovative on what their server offers and not just copy paste the bigger servers. I also suggested a couple of pages back about Mojang expanding the amount of customization that can be done with the game. Different tinted blocks or custom looking chests that only applies if the player placing it is a paying player. Restricting horse colors could also work since colors do not affect on how effective a horse is and dog breeds as well.
Actually, I've run very innovative servers and giving off decent stuff and I still don't get many donations, and only once did someone do it not for rewards, since he was an admin.

I would like to know why big servers like Hypixel that sell ranks with perks that are or are not OP are supposedly being told by Mojang that they don't need to change their server.

For me being a server owner i have to say this is terrible. I charge prices for items in game and every last fund goes back into my network. With out the ability to sell classes, ranks,currency (all though i can live without this) I wont be able to sustain my network.
Out of my network community of over 100 active players only a small majority donate and for their trouble they get items and commends that give them a short term help but are still balanced meaning they are still not unbeatable.
Due to the fact i can only ask for donation with nothing in return I decided to run a survey of my current donators to see what they would say and out of the 30+ i had less than 5 say they would continue to donate.
All this means that mine and many others will have to shut down. I also ran a second survey to find out how many of my donators and normal players would continue with minecraft and i found that yet again the same 4 donators would stay playing and out of the remaining 300 players who play through out the different time zones only 60 would also continue due to the fact that many of their other favorite server were also going down.
this is not ment to rile up hate but more to say this is the only way we can get players to donate which in turn allows those non paying people (no offense but most of you haters) who expect to go onto servers and just take not give back to people who spend hours working on them.
The custom coders who spend hours coding plugins for you to enjoy, server owners who pay for your servers and constantly monitor them to keep them up 24/7 and website coders (in our case different to plugin coders) who slave away for hours every week updating stuff fixing up anti ddos and more.

You are allowed to accept donation from your players.....but can’t give them preferential treatment for donating. You are not allowed to restrict gameplay features in an attempt to make money.
Most kits I've seen sold don't really restrict gameplay - only offer a 'shortcut' to getting good 'normal' stuff since they contain 'normal' tools/weapons & Armour you can usually get in-game - but it does give 'preferential treatment' (e.g getting ores without mining, potions without making) to players.
So in this case - are we breaking the EULA or not ??

The server I play on offer a re-usable time-limited 'builder' kit that contains a limited number of Chiselled stone .. this is great for builders
We don’t mind you selling items in game, but they must be purely cosmetic. Pets, hats, and particle effects are OK, but swords, invincibility potions, and man-eating pigs are not
Most 'cosmetic' stuff I've seen you can usually get with client side mods anyway.. I'm not sure how you could charge people for a 'rei minimap' feature if they can just install the Mod... & what about access to certain commands.. where does that fit in..

First off you are removing things from their list. That is not good, or fair at all. You are missing the part about selling in-game items being prohibited. Now at first I was not so sure about this, because I didn't think about it clearly. The problem with minecraft nowadays is that big servers, such as mineplex, are hogging all the players. Now my server has a max of 20 PLAYERS, because I pay $6.99. The thing that mineplex is doing is upgrading the server so much so that they can get more donations and get richer. Other server such as Hypixel and such do the same. The problem with this isn't just the money they are earning. The problem is that all minecraft players are beginning to clump into very few, but large servers, and nobody else is on any other server. Whats wrong with that? It gets boring after a year, and makes me want to quit minecraft. Everyone is online the big servers, so you kind of have to stay there to be with others. However, you end up playing the SAME games, ALL THE TIME ON THE SAME SERVER with no change whatsoever. This is a very big issue, and I am thinking about trying to solve it by making a thread on the topic to inform people. After starting to make my server, and reading the EULA, would it be possible to create an agreement a player must ACCEPT when they join that would state "This server contains perks that the EULA may deem unfair, If you disagree with this leave or type /disagree" [/disagree kicks them] If they want to continue they must click "Agree" Would that then allow me to give perks to people who donate such as custom quests and parkours?
No, you can't, it doesn't work like that. Regardless of any agreement between you and your players, you do not have any authority to strip Mojang of its rights. If you are running their software and agreed to the licence, you are bound by it. If the users agreed to Mojang's licence terms, they are bound by it.
You cannot simply disregard the conditions of the agreement just because you form an additional agreement with someone else. That's like selling pirated copies of Windows and claiming that since you and the customer are fine with it, then Microsoft has no claim. Doesn't work that way, mate.
Currency can not be sold as per the EULA, Okay I understand that, But can currency be earned say by having a Microtask type think Crowdflower. where a users completes tasks for ingame credits, its not technicly earning so is it Legal?
It's legal.An idea I thought of is when people donate, they get these donor points that they can trade with other people, but not buy in-game items from shops from. Would this be legal? The whole point of having donor points would be to show off that they donated and they can trade with people if they'd like.

You know, there's something else that everyone also seems to forget. One of the core reasons for this to be enforced more recently, is due to the amount of calls they (Mojang) are getting from irate parents.
Well, what if the answer, to keep everything how it is, is for you to have a nice big page, for parents, with contact numbers where they can call you as a server owner and get their money back "if little Johnny took their credit card and used it illegally".
You return the money to said parent and Mojang don't get the call Everyone is happy.
How many Server Owners are prepared to do that though? I don't think I've ever seen/been on a server that offer any kind of support for parents where they can get refunds due to misuse. It's always "This is a donation, you agreed to our terms, tough ".
Personally, I believe that a full refund should never happen. It's the parents fault. On any other thing on the internet or sometimes even at physical stores, a kid can use their parent's credit card if the parents are irresponsible. Maybe offer a refund for a 1/4, maybe 1/3 of the money.

Have a the server free to play, but have donations a donation will give everyone not just the donator in game money, but everyone on the server the same amount of in game money. I see this idea working it will allow people to donate and everyone gets something in return it would work and its not illegal with the new EULA. It could even apply for in game items such and such donator buys this item everyone on the server gets that item. So donators would be helping all in game players and helping pay for the server its win win for everyone.

the problem comes when you realize you have over 3000 individual players on the server, and if everyone gets the same amount then if enough people donate then everyone will be able to buy everything and nobody will donate anymore because there's no reason to.
