Guys. I have found a loophole. They said you couldn't make profit. They never said that you couldn't sell things for what they're worth! But stuff on servers will cost like, $0.01 though.
Other game servers to other games kinda got around it by publicly showing the costs of running the server for the previous month and setting a donation goal of the cost per month. When the goal is reached they close donations. This shows that all the money goes directly to the server costs. This method has no pool from which you would use to upgrade the server / other fun things. People who donated also received nothing in return except a thank you. They do this because they love the game. It is possible something like this would be allowed to help cover server costs. Making it a community run server and you would let the server community poll for mods / whatever else will be done. Directly selling items as a means of recovering costs in a game make it Pay to Win. I do not see these as good for the community.
Not that I will not discuss the games here or give any names just giving a personal account of how you could host a server and not have to pay ( a lot ) out of pocket for a large one. Servers grow and if you end up with a server that people like to play on and you can't afford to pay for it anymore it closes or donations are accepted to sustain it.

Since Mojang changed the EULA, we're forced to accept their EULA before running a server. The most important rule is: You're not allowed to earn money in any way with Minecraft. This doesn't make any sense at all and it also destroys the community. Let me explain that last thing:
Server owners will stop running servers because they're not allowed to earn money with it, so they can't pay the bills and developers. Minecraft artists, who make parodys, drawings and more, aren't allowed to sell their work as it's using Minecrafts content. Mojang has to change this, or it'll destroy the game and its community.

My rich friend owns the number 3 most popular server on TF2, he has no problems paying for the server with donation money and often has excess for future months, want to know what he does if he wants to buy a game? "Oh I'll just say I need help with money to keep the server up they won't mind," he's the nicest person irl, and that's what he does if he wants a game on steam... who's to say this doesn't happen on minecraft as well?
3. If people are making parodies and mods and such for a game, how dare they ask for money? No. To all of your post. First and foremost, Mojang didn't "change" the EULA. The whole "you can't sell (parts of) our game" and stuff have always been there, they just never bothered to point out how people were violating it.
Literally no company allows you to profit off of the hard work they put into their videogame.
Literally every videogame require you to accept their EULA when you install it. You know, the large pile of words people automatically and blindly click "I accept". 1.7.10 just makes sure you don't have any crappy "I didn't agree to anything" excuse because there's literally nothing forcing you to accept the pile of words, blindly or otherwise, since it's all tucked away in an optional page on Mojang's website.

It won't destroy anything. Almost every major game has this sort of agreement. It may be YOUR copy, but it's not your game.. They aren't looking to destroy the community. Call me a mojang sucka all you want, but have you not seen the amount of minecraft rip-offs, stolen code, etc on the Apple app store and etc.. Please search minecraft and see how many paid rip-offs you find.

You are not selling the game on youtube. You are selling entertainment. I would not watch a youtube video of someone playing minecraft if they weren't at least talking. Also the way the monetary system works on youtube means you make your money from ad sense OR from people viewing the video. This means your income from the video is tied to how entertaining it is to watch. Entertainment means different things to different people but I would say the youtuber would need to be funny. This means in my opinion there is no problem with youtube or twitch streams at all right now. That is also handled in a different portion of the EULA.

I personally hate adfly. You could do the same if you paid for webhosting ( not that expensive really ) and just had google ad sense up and allowed people to download the map from your website. That said using adfly to host a map to download would indeed be attempting to turn profit ( albeit very little ). With a website that you pay for, the donations would go to the cost of the website and not directly into your bank account to spend because you made a cool map with the tools that they give you or you found a cool seed.

I would say this is the fault of Mojang not cracking down on these servers that violate their EULA earlier. They aren't trying to kill those servers. They are trying to get the most money out of their product. Sure this is not the best way to do it I agree. However servers with community backing will probably remain and after discussion with Mojang will probably ( note that I do not know this for a fact ) give Mojang a fee of some kind for being allowed to use their game to make money. Server owners will ( most likely ) talk to Mojang and terms will be laid out and will need to be followed just like a proper business. That or the server accepts donations without any gifts to donators except something like a hat that can't be gotten in game except for donating. You know fluff stuff. Maybe your name gets a new color in chat who knows. Then after a donation goal for the month is reached donations are closed just like a true community run server would be.

This seems like a good change. I stopped playing multiplayer altogether because every single server I played on was a ball of garbage. Even the one my friend ran suddenly became one of those "Donator" servers where you "donate" by buying actual items, like overpowered pickaxes and swords. I thought that was an isolated case but the server it merged with had the same thing. Pushing people to become members on their enjin forum, for example.Note that the EULA does not prevent donations, since donations are not considered Earnings, but rather nontaxable income. Also Videos/Derived art is still perfectly allowed, and can be sold or used for ad revenue. FLIPPING FINALLY. Someone that understands. JUST reading the idiotic responses to the Petition you will see that everyone out there is treating minecraft as some type of "Get Rich" Scheme. Here are just a few I pulled off the petition. ALL of these people NEED to uninstall the game right now. First things first, I KNOW you can make money off of games. Such as selling EXTRA services that are no related to the game itself. Such as Clothes, Art, Free-lance work etc. But when you are creating a "lobby" for people to play in, and you pay for it. That is on you, you should not be putting your community at large for not donating to a service that they can get pretty much anywhere else for free. When you start limiting the game, and giving advantages to players who "Donate" for a rank, that is when it draws the line. You're selling "features" of the game that mojang created. I don't give a flying finger if you think it's "REWARDING" because at the end of the flipping day it is selling a feature or service. Just because other people pay for a server, doesn't mean you have to. This selling/donating thing has been going on for long enough. In the beginning of bukkit, people did it as a nice way to say "thank you" towards the server owner. But now it's out of hand. 80$ for a flipping name tag on a server, and a few extra abilities? really? The current EULA has always stated you are not allowed to sell back bits of minecraft to people who have already bought it. Meaning, if you run a server and you accept donations then you can't reward someone with an enchanted diamond sword for it. That would be a transaction from a legal stand point, and one that uses Mojang assets. You cannot sell something you didn't make.
I think Mojang is addressing an issue where people are doing a great job scamming kids out of money by offering perks which are just bastardizations of their intellectual property; art and code.
This kind of adverse reaction from the community just proves how young and unknowledgeable the player base averages out to be. It seems to me that if you support players giving server owners money for perks in a game that is fantastic without modification then you are too childish to be spending money at all.

I don't know exactly where you live, but on most countries, USA included, this "Freedom of Expression" only applies against the government. If you walk into a mall or someone's house and you start shouting obscenities they have every right to kick you out of the location.
I had a link to one of Marc's posts on reddit covering the last few questions on your post, I couldn't find it. Since I don't have the source, you should take this with a grain of salt, however. Essentially this is how it works:
1) If you give the server money and you get something in return (diamond sword, colored names, etc.), that's a purchase, and not okay.
2) If you give the server money and you get nothing in return (the real definition of donating), that's okay.
3) If you give the server money and you get an item in return as a "thank you" it's okay as long as the item comes completely out of the blue - in other words, it wasn't advertised or agreed upon as a reward.
