I think you mentioned in the OP that no one can distribute the mod in public modpacks, but it seems like LifeMMO distributed the mod AND modified it on their on use... http://lifemmo.moonfruit.com/ <<< They have been known to distributed mods without permissions too - not sure if they have asked you... They also have been linked with several illegal music distributions too.
Posting it here does nothing. You can't get into legal trouble for not asking for permission. I'm not saying it's a good thing to do but that's the reality of the world we live in.

And things like this have been dealt with a lot of times, it just needs the owner's attention if he wants to act or not.
If the company that owns the server on which the mod pack is hosted operates in the U.S.A., the mod's creator could send a DMCA notice. The company will probably want to follow the law, more than the modpack's creators do.

After lots of research to see if that's possible and if the modder has the right to do that for this game you're right the modder can do that since it's their property and not Mojang's (According to the terms of use). While researching I also saw that a lot of mods have gotten taken down for illegal use and stealing content and claiming it as their own (You were right Rongmario). Looks like you learn something new every day. But since I don't know much about the law I have a question if the modder does submit a DMCA request and the content gets taken down does the modder get anything like money?
Hey dude, this mod is cool and all, but i don't have a 'coremods' folder. I am on a mac, though, and that is probably why it's not there. Anyway, if anyone knows, please reply!

Inform them to remove it. I've seen it happen many times.
It's their decision.

I would like to let you know that you should really continue this project.
If you don't feel you're up to it, I certainly am, and will be glad to continue it for you.
I support you!
However, if the author does not respond?
Well, since it's on GitHub I can just fork the repository, and use it for myself. XD
